These Terms & Conditions / Terms of Service (“Terms”) govern your access to and use of the websites, mobile or web applications, AI-assisted travel planning tools, itinerary builder, map and discovery features, account services, support services, provider pages, paid access services, travel advisor services, and related products or services offered by Travel New Zealand LLC (“Travel New Zealand,” “we,” “us,” or “our”) that link to these Terms (collectively, the “Services”).
The terms “you” and “your” refer to the person accessing or using the Services and, where applicable, any person or group on whose behalf you access or use the Services.
By accessing or using the Services, creating an account, purchasing paid access, saving an itinerary, using an AI assistant, submitting content, contacting support, engaging travel advisor services, or using any paid or free feature, you agree to these Terms.
If you do not agree to these Terms, do not use the Services.
1. Service Overview
Travel New Zealand provides travel discovery, informational guidance, itinerary organization, map-based exploration, destination content, provider information, AI-assisted planning, and related tools for New Zealand travel.
Travel New Zealand is an independent travel planning app operated by Travel New Zealand LLC. We are not affiliated with, endorsed by, or sponsored by Tourism New Zealand, the New Zealand Government, the Department of Conservation (DOC), Waka Kotahi NZ Transport Agency (NZTA), or any official tourism authority unless expressly stated. References to official sources are provided so you can verify information directly with those sources.
The Services are designed to help users explore ideas, organize preferences, compare possibilities, and structure potential travel plans. The Services do not make travel decisions for you. You are solely responsible for deciding whether any destination, route, supplier, activity, accommodation, itinerary, recommendation, or information is appropriate for you.
2. Important Travel and AI Disclaimer
The Services provide informational direction only.
The Services do not provide legal advice, immigration advice, medical advice, health advice, insurance advice, financial advice, emergency advice, safety advice, weather-alert services, hiking-safety services, road-safety services, booking advice, or professional travel-agent advice unless you separately engage us for specific travel advisor services.
AI-generated content, itinerary suggestions, destination descriptions, map information, route ideas, estimated drive times, provider information, activity suggestions, and travel guidance may be inaccurate, incomplete, outdated, misleading, unavailable, or unsuitable for your circumstances.
You must independently verify all travel information before relying on it, including information about:
- Visas, NZeTA, passports, entry requirements, immigration rules, and border requirements
- Health requirements, vaccines, medications, travel insurance, and medical suitability
- Weather, severe weather, natural hazards, road conditions, ferry conditions, and closures
- DOC tracks, huts, campsites, alerts, trail conditions, safety notices, and bookings
- NZTA road conditions, driving routes, closures, construction, hazards, and estimated travel times
- Accommodation, activity, transport, airline, rental car, ferry, and supplier availability
- Prices, opening hours, cancellation policies, refund policies, and booking terms
- Local laws, customs, regulations, warnings, and official government advisories
You should verify information using official government, supplier, booking, transport, health, weather, DOC, NZTA, immigration, and local authority sources.
You use the Services at your own risk.
3. Not for Emergencies or Real-Time Safety Decisions
The Services are not emergency services.
Do not use the Services as your only source for emergency decisions, evacuation decisions, medical decisions, severe weather response, road safety, trail safety, river crossing decisions, alpine travel, remote-area travel, natural disaster response, or any real-time safety-critical situation.
In an emergency, contact local emergency services and follow official instructions.
4. Eligibility
You must be at least 13 years old to use the Services. If you are under the age of majority in your jurisdiction, you may use the Services only with involvement and permission from a parent or legal guardian.
You represent that you have the legal authority to agree to these Terms and, if you use the Services on behalf of another person, group, company, or provider, that you are authorized to act on their behalf.
5. Accounts
You may need an account to use certain features. You agree to provide accurate information and keep your account information current.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly if you suspect unauthorized account access.
We may suspend or terminate accounts that violate these Terms, create risk, abuse the Services, provide false information, infringe rights, or harm users, providers, partners, or Travel New Zealand.
6. User Responsibility
You are responsible for:
- Your travel decisions
- Your reliance on app content, AI output, route ideas, maps, or suggestions
- Verifying information through official sources
- Determining whether travel is safe, lawful, suitable, and appropriate for you
- Obtaining travel documents, visas, NZeTA authorization, insurance, permits, medical clearance, and supplier confirmations
- Reading and complying with supplier terms
- Reviewing bookings, dates, legal names, documents, and confirmations
- Understanding cancellation and refund rules before purchasing or booking
- Your own conduct while traveling
- Ensuring all members of your party understand relevant information, risks, and terms
Travel involves inherent risks. You voluntarily assume those risks.
7. AI Assistant and Planner Features
The AI assistant and planner tools may generate suggestions based on your inputs, general travel information, app content, maps, known destinations, estimated routes, provider information, and other data.
You understand and agree that:
- AI outputs are not guaranteed to be accurate
- AI outputs may omit important information
- AI outputs may misunderstand your preferences
- AI outputs may produce impossible, unsafe, inefficient, unavailable, or outdated suggestions
- AI outputs are not a substitute for human judgment, professional advice, official sources, supplier confirmations, or local conditions
- You are solely responsible for evaluating and verifying AI-generated information before acting on it
We may modify, limit, remove, or discontinue AI features at any time.
8. Maps, POIs, Routes, Trails, and Drive Times
Maps, places of interest, provider listings, routes, trails, drive times, distances, alerts, pins, descriptions, and related content are provided for general informational use only.
They may be inaccurate, incomplete, duplicated, outdated, misplaced, unavailable, or affected by changing conditions.
Drive times may not account for road closures, weather, traffic, daylight, fatigue, ferries, rest stops, terrain, driving skill, seasonal conditions, or local restrictions.
Trail and outdoor information may not reflect current hazards, closures, river levels, avalanche risk, weather, track damage, hut availability, booking requirements, or user fitness.
You must verify all route, road, trail, weather, booking, and safety information with official sources before relying on it.
9. Paid App Access
We currently offer one paid access product: a one-time purchase that unlocks full planner access for a fixed two-year access period (a “Trip Pass”). The price and access period are shown at checkout. Prices are in US dollars and do not include sales tax. Where we are required to collect sales tax on your purchase, it is calculated from your billing address, shown at checkout before you pay, and added to the price; the total shown at checkout is the amount we charge. Our refund policy is set out in this section.
Unless stated otherwise at purchase:
- Paid access is a one-time purchase charged in advance; it is not a subscription
- Access lasts for the two-year access period and does not auto-renew; there is no recurring billing. When your access period ends, you may choose to purchase another access period
- Access begins when payment is processed and continues for the disclosed access period
- We may change pricing, access periods, or included features for future purchases with appropriate notice where required
- Payment failures, chargebacks, or reversals may result in loss of paid access
Refunds
Because a Trip Pass gives immediate access to digital features for a fixed period, we generally do not offer refunds for change of mind or for unused time in an access period. We will provide a refund, replacement, or other appropriate remedy where the paid features materially fail to work as described or are withdrawn during your access period, where applicable law requires it, or where we otherwise choose to in our discretion. Refunds are handled according to this policy, subject to non-excludable consumer law.
To request a refund, contact info@travelnewzealand.com from the email address on your account. Approved refunds are returned to the original payment method through our payment processor.
Nothing in these Terms limits any refund, cancellation, or consumer guarantee rights that cannot be excluded under applicable law.
Payments are processed by third-party payment processors on their hosted checkout pages. If we later offer purchases through Apple, Google, or another app store, that store’s billing, cancellation, and refund rules may also apply to those purchases.
10. Support Messaging
Support messaging, where available, is for verified member technical support, account support, billing support, and product support.
Support messaging is not for:
- Travel advice
- Itinerary consulting
- Reservation support
- Supplier support
- Booking help
- Emergency assistance
- Immigration advice
- Medical advice
- Legal advice
- Road, weather, hiking, or safety-critical decisions
We may decline, redirect, close, or delete support requests that fall outside the intended support scope.
11. Provider Listings, Sponsored Placement, and Paid Visibility
The Services may include provider pages, business listings, destination content, accommodations, activities, tours, transport providers, travel services, or other third-party information.
Some listings, placements, badges, rankings, promotions, or visibility features may be paid, sponsored, enhanced, or otherwise commercially supported when those features are offered.
Paid visibility is not an endorsement, certification, safety guarantee, quality guarantee, availability guarantee, booking guarantee, or recommendation by Travel New Zealand. Where a listing, placement, or link is paid or sponsored, we will identify it as such.
We may receive a commission, referral fee, or other compensation if you book, visit, or purchase through certain links, or if you request booking or travel advisor assistance that we arrange with suppliers. Any such compensation does not mean we have verified, endorsed, or guaranteed the provider or its services.
Providers are responsible for the accuracy of their own listing information, images, services, prices, availability, claims, terms, policies, and legal compliance.
We may edit, reject, suspend, remove, label, or limit provider content at our discretion.
12. Third-Party Links, Suppliers, and External Services
The Services may link to or display information from third-party websites, official sources, suppliers, providers, booking platforms, government agencies, map providers, payment processors, app stores, insurers, advisors, accommodations, activity providers, transportation companies, and other third parties.
We do not own, operate, control, supervise, or guarantee third-party services.
We are not responsible for:
- Third-party accuracy
- Third-party availability
- Third-party prices
- Third-party booking terms
- Third-party cancellations or refunds
- Third-party insolvency or bankruptcy
- Third-party privacy practices
- Third-party safety practices
- Third-party service quality
- Third-party errors, omissions, delays, closures, overbooking, injury, loss, or damage
Your use of third-party services is at your own risk and subject to that third party’s terms and policies.
13. User Content
You may submit prompts, preferences, planner notes, saved trips, feedback, images, messages, provider descriptions, support attachments, or other content (“User Content”).
You represent that you have all rights necessary to submit User Content and that your User Content does not violate law, infringe rights, disclose confidential information, contain malware, or violate these Terms.
You grant Travel New Zealand a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, process, reproduce, modify, display, transmit, analyze, and use User Content as necessary to provide, operate, improve, secure, market, and support the Services.
For provider content intended for public display, you grant us the right to display, promote, modify for formatting, and distribute that content through the Services.
You remain responsible for your User Content.
14. Acceptable Use
You agree not to:
- Violate any law or regulation
- Use the Services for unlawful, harmful, fraudulent, deceptive, abusive, or exploitative purposes
- Interfere with or disrupt the Services
- Attempt to gain unauthorized access to systems, accounts, data, or networks
- Scrape, crawl, copy, harvest, or extract data except as expressly permitted
- Reverse engineer, decompile, or attempt to derive source code except where legally permitted
- Misuse AI features or attempt to bypass safety systems
- Upload malware, harmful code, or security threats
- Impersonate another person or provider
- Misrepresent provider information, availability, affiliation, sponsorship, or endorsement
- Submit false, misleading, infringing, defamatory, obscene, or unlawful content
- Use the Services to make safety-critical decisions without official verification
- Use support messaging for emergencies or travel advisor services unless those services are separately offered
15. Intellectual Property
The Services, including software, design, text, graphics, logos, icons, maps created by us, compilation, interface, features, workflows, trade names, trademarks, and content created by Travel New Zealand, are owned by or licensed to Travel New Zealand and protected by intellectual property laws.
You may use the Services only as permitted by these Terms.
You may not copy, modify, distribute, sell, lease, sublicense, or exploit the Services except as expressly allowed.
16. Feedback
If you submit ideas, suggestions, corrections, improvements, feature requests, or feedback, you grant us the right to use them without restriction or compensation to you.
17. Changes to the Services
We may modify, suspend, limit, replace, or discontinue any part of the Services at any time. Features may change before or after launch. We do not guarantee that any feature, provider listing, AI tool, map layer, support option, paid access option, or travel advisor service will remain available.
18. Travel Advisor and Booking Services
This section applies only if you separately engage Travel New Zealand for travel advisor, planning, booking, referral, or supplier-related services.
The app’s general informational features do not, by themselves, create a travel advisor relationship, booking relationship, agency relationship, fiduciary relationship, or obligation to plan, book, modify, cancel, or support your travel.
Travel advisor or booking services are not offered through the app today. If they are separately offered and agreed in writing in future, a separate written Travel Services Agreement, invoices, supplier terms, authorization forms, disclosures, and cancellation policies will apply to that engagement.
In-App Booking Support Requests and Partner Referrals
The app may offer an optional “Request Booking Support” action for selected itineraries. Submitting a request is not a purchase, a booking, or an engagement of Travel New Zealand as your travel advisor. It asks us to review your itinerary and consider whether booking support is available.
If you submit a request, Travel New Zealand may review it and contact you, and may, where appropriate, refer your request, your itinerary and trip details, and your contact information to an independent New Zealand booking partner. That partner may contact you, provide quotes, arrange or assist with bookings, and provide in-country assistance under its own terms. Any booking you make is a contract between you and the partner or the supplier, and their terms, prices, availability, cancellation and refund policies, and privacy practices apply.
No booking exists, and no price or availability is held, until a booking is accepted and confirmed through the partner’s or supplier’s own process. Booking support, quotes, availability, prices, and partner assistance are not guaranteed, and we may decline any request.
Travel New Zealand may receive a referral fee, commission, or other compensation from a booking partner or supplier if you book through them. This compensation does not mean Travel New Zealand has verified, endorsed, or guaranteed the partner, the supplier, or any booking.
Separate Written Travel Services Engagements
If Travel New Zealand separately agrees in writing to arrange, book, or invoice travel for you, that separate engagement is governed by a separate written Travel Services Agreement and the applicable supplier terms, not by this Section 18. Nothing in these Terms creates such an engagement, and using the app, submitting a booking support request, or receiving a referral to a booking partner is not a written engagement of Travel New Zealand to arrange, book, or invoice travel.
19. Disclaimer of Warranties
To the maximum extent permitted by law, the Services are provided “as is” and “as available.”
Travel New Zealand disclaims all warranties, express or implied, including warranties of accuracy, completeness, reliability, availability, merchantability, fitness for a particular purpose, title, non-infringement, safety, suitability, and uninterrupted operation.
We do not warrant that the Services, AI outputs, travel content, provider listings, maps, itineraries, route suggestions, support responses, or third-party information will be accurate, complete, current, secure, uninterrupted, error-free, or suitable for your needs.
Nothing in these Terms, including this Section 19 and Sections 20, 21, 25, and 26, limits any refund, cancellation, or consumer guarantee rights that cannot be excluded under applicable law, including, where they apply to you, consumer guarantee and consumer protection laws in New Zealand, Australia, the United States, the United Kingdom, and the European Union. Where such laws apply, our liability for a failure to comply with a non-excludable guarantee is limited, to the extent permitted, to resupplying the Services or paying the cost of resupply.
20. Limitation of Liability
To the maximum extent permitted by law, Travel New Zealand and its owners, officers, employees, contractors, agents, affiliates, suppliers, licensors, and partners are not liable for indirect, incidental, consequential, special, exemplary, punitive, or enhanced damages, including lost profits, lost data, lost opportunity, lost enjoyment, travel disruption, missed bookings, missed flights, cancellations, delays, injury, death, property loss, emotional distress, or reliance damages.
To the maximum extent permitted by law, Travel New Zealand is not liable for claims arising from:
- Your reliance on AI output
- Your reliance on travel information
- Your travel decisions
- Inaccurate, incomplete, outdated, or unavailable content
- Maps, POIs, routes, trails, drive times, alerts, or provider listings
- Third-party websites, suppliers, advisors, providers, booking platforms, insurers, app stores, or payment processors
- Supplier acts, omissions, negligence, insolvency, bankruptcy, delays, cancellations, refunds, credits, closures, substitutions, or service failures
- Weather, road conditions, trail conditions, health issues, government action, border decisions, natural hazards, or force majeure
- Unauthorized account access caused by your failure to protect credentials
- Service interruptions, data loss, bugs, errors, or security incidents despite reasonable safeguards
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Services or these Terms will not exceed the amount you paid to Travel New Zealand for the specific Service giving rise to the claim during the six months before the claim arose, or $100 USD if you paid nothing.
Some jurisdictions do not allow certain limitations, so some limitations may not apply to you.
21. Indemnification
You agree to indemnify, defend, and hold harmless Travel New Zealand and its owners, officers, employees, contractors, agents, affiliates, suppliers, licensors, and partners from claims, losses, liabilities, damages, judgments, settlements, costs, and expenses, including reasonable attorney’s fees, arising from:
- Your use or misuse of the Services
- Your travel decisions
- Your User Content
- Your violation of these Terms
- Your violation of law
- Your violation of third-party rights
- Your provider listing, business content, or submitted media
- Your conduct while traveling
- Your failure to verify information or comply with supplier, government, health, border, or travel requirements
22. Termination and Suspension
We may suspend, restrict, or terminate your access to the Services at any time if we believe you violated these Terms, created risk, provided false information, infringed rights, misused the Services, failed to pay required fees, or acted unlawfully or abusively.
You may stop using the Services at any time. Certain provisions of these Terms survive termination, including intellectual property, disclaimers, limitation of liability, indemnity, and dispute terms, together with any payment or cancellation obligations under a separate written Travel Services Agreement.
23. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted with a new “Last Updated” date.
If changes are material, we may provide additional notice where required. Your continued use of the Services after updated Terms become effective means you accept the updated Terms.
For any separately agreed travel services, the written Travel Services Agreement, supplier terms, and written documents provided to you at the time of the engagement apply.
24. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules.
25. Disputes, Venue, Class Action Waiver, and Jury Waiver
Any claim or dispute arising out of or relating to these Terms, the Services, travel advisor services, booking services, or your relationship with Travel New Zealand must be brought in a court of competent jurisdiction located in Texas, unless applicable law requires otherwise.
You agree to bring claims only in your individual capacity and not as a plaintiff or class member in any class action, collective action, representative action, or private attorney general action.
You waive any right to a jury trial to the maximum extent permitted by law.
Travel New Zealand will not be liable for punitive damages to the maximum extent permitted by law.
26. Notice of Claim
To the maximum extent permitted by law, no claim will be considered unless you first provide written notice of the claim to Travel New Zealand within 30 days after the event, travel date, cancellation, or issue giving rise to the claim.
The notice must describe the claim in reasonable detail and be sent to info@travelnewzealand.com or our mailing address below.
27. Severability
If any provision of these Terms is found unlawful, void, or unenforceable, that provision will be severed or limited to the minimum extent necessary, and the remaining provisions will remain in effect.
28. Entire Agreement
These Terms, the Privacy Policy, any paid access terms, any travel advisor documents, invoices, authorization forms, supplier terms, and written disclosures provided to you constitute the entire agreement between you and Travel New Zealand regarding the Services.
